UWH Portal Terms and Conditions

Atlantis reserves the right, at its sole discretion, to modify or replace these Terms at any time. We will endeavor to provide reasonable notice of material changes, typically by posting the updated Terms on the Platform and sending a notification.

Your continued use of the Platform after the effective date of any revised Terms constitutes your acceptance of the revised Terms and your agreement to be bound by them. You are responsible for reviewing these Terms periodically for changes, as the most current version will always apply.

To access certain features of the Platform, you will be required to register for an account. By creating an account, you represent and warrant that you are at least 18 years old. If under 18, a parent or legal guardian must first create an account and then add you as a dependent and explicitly consent to these Terms on your behalf, acknowledging full responsibility for your actions and compliance with these Terms.

You agree to provide accurate, current, and complete information during the registration process and to promptly update such information to maintain its accuracy and completeness. You are solely responsible for safeguarding the confidentiality of your password and for all activities that occur under your account, whether or not authorized by you. You must immediately notify Atlantis of any unauthorized use of your account or any other breach of security.

The Platform facilitates interaction between various user roles, including, but not limited to, Tournament Organizers, Team Organizers, Admins, Players, Referees, and Spectators. Your specific rights, responsibilities, and access to Platform features are strictly limited by your assigned role and the subsequent permissions granted to you by your role via the functionality enabled by Atlantis.

You agree to comply with all rules, guidelines, and directives applicable to your role, any specific event or program, and these Terms.

You agree to use the Platform only for its intended purpose related to underwater hockey Events and Programs/Clubs. You agree not to engage in any of the following prohibited activities:

• Posting, transmitting, or sharing any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, libelous, vulgar, obscene, racially, ethnically, or otherwise objectionable.
• Posting, transmitting, or sharing any content that invades the privacy or publicity rights of any third party.
• Posting, transmitting, or sharing any content that promotes self-harm, violence, or criminal activity.
• Infringing upon the intellectual property rights (including copyright, trademark, patent, trade secret) or other proprietary rights of Atlantis, its licensors, or any third party.
• Uploading, transmitting, or facilitating the transmission of viruses, corrupted data, or any other malicious code or technologically harmful material.
• Engaging in spamming, phishing, scraping, or any other form of unsolicited or unauthorized advertising or promotional material.
• Using any automated system, including 'robots,' 'spiders,' 'offline readers,' or similar technology, to access or interact with the Platform in a manner that exceeds reasonable human interaction or imposes an unreasonable load on the Platform's infrastructure.
• Attempting to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Platform, the server on which the Platform is stored, or any server, computer, or database connected to the Platform.
• Masquerading as another person or entity.

The Platform may include forums, discussion boards, and other interactive features (“Forums”) where users can post content, messages, and comments. When using the Forums, you agree to the following guidelines:

• Do Not Share Private Information: Never post personal information about yourself or another forum participant, including real names (if not already public by the individual), contact details, or other sensitive data.
• Respect and Courtesy: Treat all other users with respect and courtesy, even when disagreeing. Personal attacks, harassment, bullying, or abusive language are strictly prohibited. Focus your comments on ideas and not on individuals.
• Constructive Engagement: Engage in discussions thoughtfully and constructively. Provide feedback in a positive and helpful manner.
• No Hate Speech: Do not post anything that could be considered intolerant of a person's race, culture, appearance, gender, sexual preference, religion, age, or any other protected characteristic.
• No Obscenities or Foul Language: Obscene or profane language is not permitted. This includes disguised or intentionally misspelled swear words.
• Stay on Topic: Keep your contributions relevant to the specific discussion topic. Avoid off-topic posts or cross-posting the same message across multiple threads.
• No “Trolling”: Do not intentionally incite annoyance, offense, or disrupt the discussion. Posts should add value to the conversation.
• Proper Language and Tone: Use proper grammar, spelling, and punctuation to ensure clarity. Avoid excessive use of slang, jargon, or all capital letters (which is considered shouting).
• No Advertisements: Do not post commercial messages, advertisements, or solicitations for products, services, funds, or donations without explicit permission from Atlantis.
• No Moderation Complaints: Do not post complaints about site moderation in public forums. Direct any concerns about moderation decisions via email to support@atlantissports.org.
• Reporting Violations: If you encounter content that violates these Terms or is otherwise inappropriate, please report it to Atlantis via email to support@atlantissports.org rather than engaging in a public dispute.
• Read Before Posting: It is advisable to read through existing posts and the thread topic before contributing to avoid repetition and ensure your contribution is relevant.

Users who are granted Organizer permissions (Team Managers, Event Admin, or similar elevated permissions) must first additionally accept the Organizer Access & Data Handling Terms, which are incorporated into these Terms by reference.

Organizer permissions may be suspended or revoked for misuse, policy violations, or security risk.

The Platform and all its content are owned by Atlantis Sports, its licensors, or other providers and are protected by intellectual property laws. You have a limited license to use the Platform for personal, non-commercial purposes. You may not reproduce, distribute, or modify any material on the Platform without permission.

By submitting User Content (like forum posts or photos), you grant Atlantis a license to use this content to operate and promote the Platform. You confirm that you own your User Content and that it doesn't violate these Terms or any third-party rights. Atlantis can monitor, edit, or remove User Content.

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE”. ATLANTIS MAKES NO WARRANTIES REGARDING THE PLATFORM'S OPERATION OR CONTENT. YOUR USE IS AT YOUR SOLE RISK. ATLANTIS IS NOT LIABLE FOR ANY DAMAGES ARISING FROM PLATFORM USE.

Atlantis Sports and related parties are not liable for indirect or consequential damages, including lost profits or data.

Atlantis is a platform provider and is not responsible for Events or Programs/Clubs organized by independent Organizers or Admins who are solely responsible for their Events and/or Programs/Clubs. Atlantis does not endorse or warrant Organizer activities. Any issues with an Event or Program/Club should be directed to the Organizer.

The Platform may link to third-party sites, but Atlantis is not responsible for their content or practices. Your use of third-party services is at your own risk.

You agree to defend and hold Atlantis Sports harmless from any claims or costs arising from your violation of these Terms, your User Content, your use of the Platform, your interactions with other users, your participation in events facilitated by the Platform, or your use of information from the Platform.

These Terms and your use of the Platform are governed by the laws of the State of Colorado, USA. Any legal action related to these Terms or the Platform will be filed in the federal or state courts in Denver, Colorado. You waive any objection to jurisdiction or venue in these courts.

Atlantis may pursue legal action against you in your country of residence or other relevant country for breach of these Terms.

Failure by Atlantis to enforce any part of these Terms does not mean it waives that right. If any provision is found invalid, illegal, or unenforceable, that provision will be limited or removed, but the remaining provisions will stay in effect.

These Terms and the Privacy Policy are the complete agreement between you and Atlantis Sports regarding the Platform, superseding all prior agreements.
